B&I Lawyers Prevail in another ADA Website Case

Brann & Isaacson lawyers Peter Brann and Hanna Wurgaft prevailed in another federal lawsuit claiming that a website was inaccessible under the ADA, this time in the Eastern District of New York on behalf of major internet retailer Crutchfield. The court agreed with them that the plaintiff lacked standing to bring the lawsuit and that Crutchfield had rendered the case moot by immediately taking steps to correct the minor issues identified in the complaint. Bill Crutchfield, the CEO of Crutchfield, described B&I’s approach as a “brilliant defense.”

“It is often difficult to justify fighting back against these cut-and-paste lawsuits when the plaintiffs’ counsel usually offer to settle them for less than the cost of responding to the complaint,” explained Brann, “but for those clients that do fight back, prevailing is priceless.” B&I lawyers have also convinced plaintiffs’ counsel to not file or to drop such cases on behalf of a number of clients.
